VISIT TO KARNATAKA STATE SC/ST COMMISSION ON 17th JANUARY 2023

This visit was conducted by the college on 17th January 2023. Students of final year LLB were taken on an educational visit to the Karnataka State SC/ST Commission. All students assembled on the second floor of the Sri Aravinda Bhavan. It was the court hall, where proceedings would regularly be held.

An introduction to the Commission was given by one of the staff members. A handbook on the Act of the Commission was handed to all students for their perusal. Another staff member of the commission gave a brief about the Commission, its establishment and brief duties.

The Act was enacted in the year 2003. This Act primarily deals with any sort of discriminatory, violent, derogatory acts committed against members of the SC/ST community. The objective of the Act is to protect such members of the community. The commission was established to counter all cases registered by such members on the above-mentioned grounds.

It was also mentioned that an aggrieved person may approach the commission only when the victim is a member of the community and the other party does not belong to the community.

The proceedings that place take is pari materia to that of a civil case proceeding. Another objective of the Act is to make suggestions regarding the issues brought forth. The Commission does not have the power to pronounce judgements. The most common nature of cases would be in the form of land grabbing, atrocities, and service matters, to name a few.

Thursdays and Fridays are the days when cases are heard. The rest of the week, the staff go about their administrative work to prepare for case hearing days.

The Presiding Officer of the Commission would be an elected member such as an elected Member of the Legislative Assembly (MLA). And two other members would assist him during the hearings.

The students were shown the application form through which persons may approach the Commission.

Post this, there was a question-and-answer session, where students clarified their doubts regarding the jurisdiction of the commission, the nature of cases, the powers of the commission and so on.

Through the Q&A session, it was answered that only members of the community who resided in Karnataka could approach this forum. This forum would come into the picture where all other means have failed, such as police complaints and internal compliance departments in offices and such. The Commission could only make suggestions/recommendations and they could also provide monetary compensation. The money for the same would be provided from the fund which has been taken care of by a treasurer.

With regard to jurisdiction, the commission can listen to matters which have already been decided by the lower courts. But it cannot surpass or listen to cases decreed by the High Court or so.

To become a member or staff of this commission, one must have to write and pass the KPSC- Karnataka Public Service Commission.
Lastly, students were offered snacks and the students offered their gratitude towards the staff for the visit.
